New ECD standards for real estate rental and sale since 2021

Since July 1, 2021, the energy performance diagnosis (EPD) has evolved.

Set up in 2006, the Energy Performance Diagnosis abbreviated as DPE aims to evaluate the energy performance of a home by assigning it a label ranging from label A for energy-efficient dwellings with label G for very energy-consuming dwellings.

According to the rules of the ELAN law of November 23, 2018, the DPE has now become legally enforceable. While the diagnosis had only an informative character before, it now constitutes a legally enforceable or contestable element, as are the diagnoses of lead and asbestos. In the event of a poor energy performance diagnosis, the purchaser or tenant will be entitled to claim compensation.

Resulting from the merger between the energy label and the climate label, the new DPE will display a joint note for the greenhouse gas emissions of housing and the poor performance in primary energy calculated with the more reliable and standardized 3CL method (Conventional Housing Consumption Calculation).

And that's not all: since July 1, 2021, landlords whose property is classified F or G in a tight area are now prohibited from raising the amount of rent in the event of a change of tenant or lease renewal.

In addition, from 1 January 2023, a dwelling may be rented out only if it does not exceed the threshold of 449 kW/h of final energy per m² of living space per year. This measure applies to rental contracts signed on or after January 1, 2023.

From 2025, energy-intensive accommodation (classified G at the DPE) will be prohibited for rental
followed by accommodation classified F from 2028 then E accommodation by 2034.

To be able to sell and/or rent a home with peace of mind, it is therefore now essential to seriously consider the Energy Performance Diagnosis and possibly undertake energy renovation work in order to benefit from better ECD label.

Finally, for diagnoses made before July 1, 2021, the validity period is reduced:

  • Diagnostics performed between July 1, 2013 and July 1, 2017 are valid until December 31, 2022.
    Diagnostics performed between January 1, 2018 and June 30, 2021 are valid until December 31, 2024.

The new DPE, meanwhile, will be valid for 10 years unless you carry out energy renovation work likely to change the classification of the diagnostic label. Take care of all these parameters before offering your property on the real estate market.

The apartment real estate market is generally homogeneous in the Gulf of Saint-Tropez and more particularly in Grimaud and Port-Grimaud.
